§ 1 Scope of Application

1.1 These Terms and Conditions ("Terms") of RINAGYM POLAND SP. Z O.O. ("Seller", "we", "us") apply to all contracts for the sale and delivery of goods concluded between a customer ("Customer", "you") and the Seller through the online store at rinagym.com. Any differing terms of the Customer are expressly excluded unless the Seller has agreed to them in writing.

1.2 A consumer as defined in these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

1.3 A business customer as defined in these Terms is any natural or legal person acting in the exercise of their commercial or professional activity when entering into a contract with the Seller.

1.4 These Terms apply to customers in all U.S. states and internationally. Where applicable U.S. federal or state law provides greater consumer protections, those protections are not limited by these Terms.

§ 2 Conclusion of Contract

2.1 Product listings on rinagym.com do not constitute legally binding offers. They are an invitation for the Customer to submit a purchase offer.

2.2 By completing the checkout process and clicking the final order button, the Customer submits a binding offer to purchase the items in their cart. The Customer may also submit an offer by email.

2.3 A contract is formed when the Seller accepts the Customer's offer by one of the following:

• Sending a written order confirmation to the Customer's email address

• Delivering the ordered goods to the Customer

• Initiating payment processing after the order is placed

2.4 The Seller reserves the right to decline any order without providing a reason, in which case any payment received will be refunded promptly.

2.5 Where payment is made via PayPal or other third-party payment platforms, the terms of those platforms apply in addition to these Terms.

§ 3 Prices and Payment Terms

3.1 All prices displayed on rinagym.com are in U.S. Dollars (USD) and are inclusive of applicable taxes unless otherwise stated.

3.2 The following payment methods are accepted:

• Credit and debit cards (Visa, Mastercard, American Express, and others as displayed at checkout)

• PayPal

• Bank transfer (details provided upon request)

3.3 Payment is due at the time of order placement. The Seller will not ship goods until full payment has been received and confirmed, except where explicitly agreed otherwise.

3.4 All transactions are processed securely through our certified payment partners. Rinagym does not store, access, or retain any credit card or banking information.

3.5 In the event of a failed or reversed payment, the Seller reserves the right to cancel the order and recover any goods already shipped, subject to applicable law.

§ 4 Delivery and Shipping Conditions

4.1 Estimated shipping times to the United States are 2–5 business days from the date of dispatch, depending on the carrier and destination. These are estimates and not guaranteed delivery dates.

4.2 Shipping is free for all orders. However, if you refuse delivery without a valid reason, a shipping fee of approximately $100 USD will be deducted from your refund to cover the return shipping costs.

4.3 The Customer is responsible for providing a complete and accurate delivery address. The Seller is not liable for delays or non-delivery resulting from an incorrect or incomplete address provided by the Customer.

4.4 Risk of loss or damage to the goods passes to the Customer upon delivery to the address specified in the order.

4.5 If a shipment is returned to the Seller due to an incorrect address, failed delivery, refused delivery, or unclaimed package, the Customer may be responsible for additional return shipping and handling costs. See our Returns & Complaints Policy for full details.

⚠ U.S. Customs & Import Duties Orders shipped to the United States with a declared value under $800 USD are typically exempt from import duties under the U.S. de minimis threshold (19 U.S.C. § 1321). For orders exceeding this threshold, any applicable duties or taxes are the responsibility of the Customer. Refusal to pay such charges does not entitle the Customer to a refund of the original purchase price.

§ 5 Retention of Ownership

5.1 All goods delivered by the Seller remain the property of the Seller until full payment of the purchase price has been received and confirmed.

5.2 Prior to full payment, the Customer may not resell, pledge, transfer, or otherwise encumber the goods without the Seller's prior written consent.

§ 6 Liability for Defects (Warranty)

6.1 The Seller warrants that all goods will be free from manufacturing defects at the time of delivery and conform to the product description on the website.

6.2 If a defect is discovered after delivery, the Customer must notify the Seller within 30 days of delivery by email at rinagym.com@gmail.com, including:

• Order number and product name

• Description of the defect

• Clear photos or video evidence of the defect

• Photos of the original packaging and shipping label

6.3 Upon confirmation of a valid defect, the Seller will offer one or more of the following remedies at its discretion:

• Replacement parts shipped at no additional cost

• Replacement of the defective product or component

• Partial refund proportional to the defect

• Full refund to the original payment method

6.4 This warranty does not apply to defects or damage caused by:

• Improper assembly, installation, or use contrary to the provided instructions

• Normal wear and tear from regular use

• Accidental damage, misuse, or unauthorized modifications by the Customer

• Damage caused after delivery by the Customer or third parties

6.5 Nothing in this section limits any statutory rights that consumers may have under applicable U.S. federal or state law, including implied warranties of merchantability or fitness for a particular purpose.

§ 7 Returns and Refunds for U.S. Customers

7.1 U.S. customers may request a return within 30 days of the delivery date. All return requests must be submitted by email to rinagym.com@gmail.com and must include the order number, product name, and reason for return.

7.2 All returns require prior written authorization from the Seller. A Return Merchandise Authorization (RMA) number will be issued once the request is approved. Do not ship any item back without first receiving an RMA.

7.3 For change-of-mind returns (no defect), the following conditions must be met:

• The item must be unused, uninstalled, and in its original condition

• The item must be returned in original, undamaged packaging with all accessories and components

• Return shipping costs are the Customer's responsibility

• The original shipping cost (approximately $100 USD for large items) is non-refundable and will be deducted from the refund if the order qualified for free shipping

7.4 Custom-made, personalized, or made-to-order products are non-returnable and non-refundable, except in cases of confirmed manufacturing defect, shipping damage, or incorrect item delivered.

7.5 Once a return is received and inspected, the Seller will notify the Customer of approval or rejection within 5 business days. Approved refunds will be issued to the original payment method within 7 business days of approval. In all cases, refunds will be processed within 30 days of confirmed return receipt, in compliance with U.S. state refund laws including California Civil Code § 1723.

In the event of any conflict between these Terms and the Returns Policy, the Returns Policy shall govern.

§ 8 Limitation of Liability

8.1 To the maximum extent permitted by applicable law, the Seller's total liability to the Customer for any claim arising out of or in connection with a purchase shall not exceed the purchase price paid by the Customer for the goods giving rise to the claim.

8.2 The Seller is not liable for indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of profits, loss of use, or loss of data, arising from the use or inability to use the goods.

8.3 Nothing in this section excludes or limits the Seller's liability for:

• Death or personal injury caused by a defective product

• Fraud or fraudulent misrepresentation

• Any liability that cannot be excluded or limited under applicable U.S. federal or state law

§ 9 Customer Data & Privacy

9.1 By placing an order, the Customer consents to the collection and processing of personal data (name, address, email, payment information) as necessary to fulfill the order and comply with legal obligations.

9.2 The Seller does not sell, rent, or share personal data with third parties for marketing purposes without the Customer's explicit consent.

§ 10 Applicable Law & Jurisdiction

10.1 These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law provisions, to the extent permitted by applicable law.

10.2 For U.S. consumer customers, nothing in this section limits any mandatory rights or protections afforded by the laws of the state in which the Customer resides, including but not limited to California, New York, Florida, and all other U.S. states.

10.3 Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Harris County, Texas, USA, subject to the Customer's right to bring claims in their local jurisdiction under applicable consumer protection law.

§ 11 Alternative Dispute Resolution

11.1 The Seller strongly encourages Customers to contact us directly at rinagym.com@gmail.com before initiating any formal dispute or chargeback. Most issues can be resolved faster and more effectively through direct communication.

11.2 If a dispute cannot be resolved directly, U.S. customers may seek assistance through:

• The Better Business Bureau (BBB): www.bbb.org

• The Consumer Financial Protection Bureau (CFPB): www.consumerfinance.gov

• Your state's Attorney General consumer protection office

• Small claims court in your jurisdiction for claims within applicable monetary limits

11.3 Nothing in these Terms prevents a Customer from exercising their rights under the Fair Credit Billing Act (FCBA) or other applicable U.S. consumer protection statutes.

§ 12 Changes to These Terms

12.1 The Seller reserves the right to update or modify these Terms at any time. Changes will be posted on rinagym.com with an updated effective date.

12.2 For orders placed prior to any change, the Terms in effect at the time of purchase shall apply.

12.3 Continued use of rinagym.com after any modification to these Terms constitutes acceptance of the updated Terms.
